POSSIBILITY TO UTILIZE JOINT ARRANGEMENT ON FISHERIES BETWEEN INDONESIA AND VIETNAM ON DISPUTED EXCLUSIVE ECONOMIC ZONE (EEZ) IN THE NORTH NATUNA SEA

Abstract

Indonesia has sea boundaries with Vietnam and they are still in dispute over the Exclusive Economic Zone (EEZ) in the North Natuna Sea. Incidents between both maritime agencies along with both fishers frequently occur in the disputed area. The two governments have already talked to reach delimitation agreement. However, such efforts are never been easy. To avoid future incidents, the two countries need to negotiate and achieve provisional arrangement to jointly manage, exploit and conserve the overlapping EEZ that are rich in fish resources. This article is written to urge government to propose provisional arrangement to Vietnam. Through juridical normative methods based on the international and national rules as well as comparative practices, provisional arrangement is possible to be made. The government is urged to set detailed arrangement that can have a positive impact on fishers and the country’s economy together with the conservation of natural resources in the area concerned.

Muhammad Faiz Aziz, Indonesia Jentera School Of Law

Muhammad Faiz Aziz, born in Bogor,20 March 1981. Aziz obtained his Bachelor of Laws degree in 2003 from the Faculty of Law, University of Indonesia. In 2016, Aziz earned a Master of Law from The National University of Malaysia. The author is a lecturer at the Indonesia Jentera School of Law with the area of interest including maritime law, private international law, business law and technology as well as law of border area. He is also a researcher at the Indonesian Center for Law & Policy Studies (PSHK). The author is also active in assisting the formulation and design of legal policies. Khamid Istakhori, Indonesia Jentera School Of Law

Khamid Istakhori, born in Temanggung, 12 February 1975. He is currently studying at Indonesia Jentera School of Law with the concentration of private and business law and continually to learn a new subject of legal practice including in maritime legal field. Khamid is the recipient of the Munir Said Thalib scholarship program, a scholarship program specifically for social activists. As a prominent activist, he is the Secretary General of the Federation of SERBUK Indonesia (FSERBUK), a national labor organization declared to be the Pioneer Federation on the Struggle for Occupational Safety and Health (OSH) for worker. SERBUK Indonesia is affiliated with the Building and Wood Workers’ International Global Union (BWI GUF) that focuses on organizing construction workers and leading in the campaign on Occupational Safety and Health. Anak Agung Anak Agung, Indonesia Jentera School Of Law

Anak Agung Made Desni Sensini, born in Denpasar, 09 December 1998. Desni is a third-year private and business law student at the Indonesia Jentera School of Law with areas interest including business law and taxation and continually to learn a new subject of legal practice including maritime and technology. Desni also has bright achievements such as 3rd Winner of Lomba Karya Tulis Ilmiah (LKTI) Sciencesational held by Faculty of Law University of Indonesia, Top 10 Article Writing Competition Danny Darussalam Tax Centre (DDTC) and Best 20 abstract of LKTI Faculty of Economics and Business Universitas Sebelas Maret (UNS). Yogi Prastia, Indonesia Jentera School Of Law

Yogi Prastia, born in Palembang, 20 February 1998. Yogi is a third-year private and business law student at Indonesia Jentera School Of Law. He has understanding about banking and finance law, business law and also tourism law.  He also has some achievements while studying in Jentera, such as the 3rd winner of LKTI Sciencesational held by Faculty of Law University of Indonesia, best presentation in the competition LKTI (Kertas) University of Hasanuddin Makassar, 3rd Winner of LKTI corruption free of economy faculty of Business University of Gadjah mada, 2nd winner  of debate competition Jentera Law Fair and debate semifinalist in competition at Padjdjaran Law Fair XI. He also has experience in organizing organizations by joining communities of tolerance, humanity, education, freedom, and other volunteer activities.
